Article 1 - General provisions relating to these general terms and conditions
The General Terms and Conditions of Sale or the " GTC " apply to the online sale in France and abroad of products offered by Blu Kirié, trading as Blusha, on the merchant website at the following address: https://blushaofficial.com/ .
The terms and conditions are made available to customers on the website where they can be viewed directly.
The General Terms and Conditions of Sale (GTC) are binding on the customer, who acknowledges, by checking a box or clicking the designated button, having read and accepted them before placing an order. Order confirmation signifies both the consumer's purchase of the item presented and the buyer's full and complete acceptance of the GTC in effect on the date of the order, which are stored and can be reproduced by Blu Kirié.
Blu Kirié states that it is not possible to purchase a product without accepting the conditions outlined below.
Article 2 - Purpose
These terms and conditions of sale aim to define the contractual relationship between Blu Kirié and the buyer, and the conditions applicable to the sale of goods offered on the online store https://blushaofficial.com/
These terms of sale shall prevail over any other general or specific terms not expressly agreed to by Blu Kirié, no other condition may be incorporated into these.
The sale is reserved for customers who are of legal age or minors with parental authorization.
Blu Kirié reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.
These Terms and Conditions are available in French and English. In case of discrepancies between the two versions, the French version shall prevail.
Article 3 – Product Characteristics
The Site is a merchant site for beachwear including swimwear (hereinafter the " Product(s) ") open to any natural or legal person (the " Customer ") using the Site.
Each product displayed on the Site is accompanied by a description provided by the supplier, outlining its essential characteristics. The customer is fully aware that the images, photos, and colors of the products offered for sale are for illustrative purposes only; alterations may occur due to photo processing or may not correspond to the actual colors due to the internet browser and screen used. Product care instructions are available on the website and on each product label.
Blu Kirié invites the consumer to read these characteristics carefully.
These products and services are on sale while stocks last, for a limited time; the customer should pay attention to the time limit of the offer's validity.
If one or more items ordered are no longer available, the Customer will be informed by email as soon as possible.
The Customer may then cancel the order for the product(s) concerned and, if applicable, be reimbursed for any sums already paid, by credit to the bank account corresponding to the bank card used for payment, at the latest within 30 days.
The Client remains responsible for the terms and consequences of their access to the Site, particularly via the Internet. This access may involve the payment of fees to technical service providers, such as Internet service providers, which remain the Client's responsibility. Furthermore, the Client must provide and is entirely responsible for the equipment necessary to connect to the Site.
The Client acknowledges having verified that the computer configuration he/she is using is secure and in working order.
The customer is aware that the goods will be delivered by post, carrier or collection from a relay point within the time frame specified during the final validation of the order.
Products and services sold on the website www.blushaofficial.com can be purchased and delivered in Metropolitan France and abroad. Blu Kirié reserves the right to modify the list of delivery countries at any time.
Article 4 – Creation of a customer account or registration
When placing an order on the Site, the Customer must first create an account to view their pre-entered data . Once created, to access their account, the Customer must log in using their username/email address. and their secret, personal, and confidential password. It is the Client's responsibility not to share their username and password with anyone. Each Client agrees to maintain strict confidentiality regarding the data, particularly their username and password, that allows them to access their account. The Client acknowledges being solely responsible for access to the Service through their username/email and password.
After creating their account, the Client will receive an email confirming the creation of their customer space.
The Client agrees, upon creating their account, to:

Article 5 – Orders
A customer wishing to purchase a product or service must:

The Customer receives an order confirmation electronically.
The Customer receives their package at the delivery address they indicated when placing their order by mail, carrier , or must collect it from a relay point within the time limits specified during the final validation of the order.
The order summary will also be accessible on the Site in the "My Account" section, under the "My Orders" category.
The Client agrees that the invoice shall be considered proof of the contractual relationship between the parties. The Client will have the option to print the invoice sent with the order confirmation.
Some Products are available for pre-order, meaning they are out of stock but the stock will be replenished: in this case, the Customer is invited to pre-order and the replenishment time is indicated under the "pre-order" button.
The payment procedure remains the same. Pre-ordered products are delivered separately from the rest of the order, within the timeframe indicated at the time of pre-order.
The Customer agrees to read the General Terms and Conditions of Sale in effect at the time of acceptance and confirmation of the delivery terms and any applicable delivery charges before payment of their order. Order confirmation and payment constitute acceptance of these terms and conditions of sale, acknowledgment of having read and understood them fully, and waiver of any right to invoke their own terms of purchase or any other conditions.
All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute a signature and acceptance of the operations performed.
Any email sent to the Customer in connection with an order will be sent to the email address that the Customer uses to log in to their account.
Blu Kirié reserves the right to cancel or refuse any order from a Customer for any legitimate reason, including in the event that:

The Customer would not comply with the General Terms and Conditions of Sale in force at the time of his order;

One of the Customer's previous orders is subject to a dispute or presents some form of payment risk.

The Client did not respond to a request for confirmation of his order that Blu Kirié sent him.
Any order modification by the Customer after confirmation of their order will not be accepted by Blu Kirié.
The information provided by the Customer when placing the order (in particular name and delivery address) is binding upon them. Therefore, Blu Kirié cannot be held liable in any way if an error during the order placement prevents or delays delivery .
By confirming the order, the buyer certifies that they are either of legal age and have the capacity to enter into a contract or have parental authorization to place the order . Authorized minors agree to inform their parents or legal guardians of the collection of their personal data, and the parents or guardians may object to its storage and/or transmission to third parties.
Except as otherwise stated in these General Terms and Conditions and without prejudice to the right of withdrawal provided by applicable law, the Customer's orders are firm and final.
In the event of a breach by the Client of any of the provisions herein, Blu Kirié reserves the right to terminate the Client's account without notice.
Article 6 – Payment methods and security
Full payment is due upon ordering.
Unless the server is unavailable, payment will be made immediately online by credit card (Visa, Mastercard) via the secure platform provided by Stripe (www.stripe.com). Payment will be processed through a secure system using the SSL (Secure Socket Layer) protocol, ensuring that the transmitted information is encrypted and inaccessible to third parties during transmission over the network. The customer's account will be debited for the order amount once the credit card details have been verified and the debit has been authorized by the issuing bank. Under no circumstances will payments be considered as deposits or down payments. Cash on delivery is not accepted under any circumstances. In accordance with Article L 132-2 of the French Monetary and Financial Code, the commitment to pay made using a payment card is irrevocable.
At the customer's request, an invoice showing the VAT will be sent to them.
Any order placed on the Site implies the Customer's guarantee that they possess all the necessary authorizations to use the payment methods available on the Site. Blu Kirié reserves the right to suspend or cancel any order if it encounters difficulties in collecting payment or if the order originates from a Customer account previously involved in fraud.
The bank card may be refused in particular if it has expired, if it has reached the maximum spending amount to which the Customer is entitled or if the data entered is incorrect.
In any event, Blu Kirié reserves the right to verify the validity of the payment, before shipping the order, by all necessary means.
The website www.blushaofficial.com is subject to a security system in order to protect as effectively as possible all sensitive data related to the means of payment used on the website.
Article 7 – Price
The price of the Products appearing on the merchant site is indicated per item and reference in euros inclusive of all taxes (TTC) taking into account any discounts and the VAT applicable on the day of the order, any change in the VAT rate may be reflected in the price of the products or services.
Blu Kirié reserves the right to modify its prices at any time, it being understood however that the price appearing on the site on the day of the order will be the only one applicable to the customer, except in the case of typographical errors or omissions.
The prices shown are guaranteed while stocks last.
The prices of the products indicated on the site, regardless of the delivery location, do not include order processing, delivery and transport costs which will be charged in addition and will be specified to the customer when validating their order.
For deliveries within the EU, the prices shown are inclusive of VAT and are in euros.
For deliveries outside the EU, the prices shown are exclusive of VAT.
It is specified that customs duties and any taxes required upon delivery of the order in certain countries are not included in the prices and are the responsibility of the customer.
Article 8 – Retention of Title
Blu Kirié retains ownership of the Products on the Site until full payment for each order has been received.
Article 9 – Delivery and Returns
Delivery
The sale of products and services presented on the site is reserved for customers residing in metropolitan France and outside metropolitan France for deliveries required in these geographical areas.
The delivery charges are those specified when finalizing the order and are accepted by validating the order .
All orders placed Monday through Friday before 12:00 PM are shipped the same day.
All orders placed Monday through Thursday after 12:00 PM are shipped the next day.
All orders placed from Friday after 12:00 PM to Sunday evening are shipped the following Monday.
All orders placed on a public holiday are shipped on the next working day.
Order processing may sometimes be delayed during peak periods, such as sales. Occasional system updates or force majeure events may result in a suspension of delivery, a change in the delivery cut-off time, and/or an extension of the delivery time.
A tracking number is provided for each order in order to track the progress of the package on the websites provided by La Poste, Chronopost, Mondial Relay, Fedex, DHL...
No changes to address, products or other details will be possible after payment confirmation.
The products are delivered to the address provided by the customer when placing the order.
It is therefore the customer's responsibility to verify that the address provided is correct. Blu Kirié cannot be held liable if the address provided by the customer is incorrect or incomplete, thus preventing or delaying delivery. The customer must provide a valid and complete address. All costs associated with reshipping products due to an error in the customer's address information will be borne by the customer.
Once your package has been received by La Poste, Mondial Relay or the carrier, our responsibility is no longer engaged.
When using a credit note or a size exchange for an identical item, the delivery costs of the next order are borne by the customer.
If the package is not received, despite the delivery status being visible in the tracking system, the customer can contact the brand for further information. They will be asked to perform several checks, provide proof of non-receipt, and file a complaint. We will then proceed after obtaining the necessary legal documentation. The customer must report any delivery issues to customer service within 7 days.

Order deliveries outside Metropolitan France are shipped via La Poste, Mondial Relay, Fedex, Chronopost and DHL and are at the customer's expense.
Any order placed on the website and delivered to a country outside of mainland France may be subject to customs duties, fees, and formalities or import taxes, payable by the recipient upon delivery of the order, at the applicable rate in the country of delivery. Blu Kirié is not obligated to verify or inform the customer of these customs duties, fees, and formalities or import taxes.
If delivery to the address provided by the customer is impossible or if the customer is absent, the package may be redirected to a post office, a carrier depot, or a nearby pickup point. In this case, Blu Kirié will not refund the delivery charges paid. Furthermore, if the package is not collected by the customer within the allotted time, the delivery charges paid remain the customer's responsibility, as well as any costs associated with reshipping if the package is returned to Blu Kirié. If the customer does not respond, they will be refunded for the order, excluding delivery charges.
If the customer is absent when a FedEx delivery is attempted at the address provided, they can, on the FedEx website, by entering the shipment tracking number in the "Tracking Number" or "InfoNotice" field:
- Have the package delivered to an available neighbor, if a signature is required
- Arrange for the shipment to be picked up at a FedEx customer center
- Reschedule the delivery date of the shipment for a day when you can receive it
- Have the shipment delivered to a different address
Delivery times provided by the postal service and carriers are estimates only. After these estimated times, the customer must file a claim with the postal service or carrier. If delivery exceeds 30 days from the order date, the sales contract may be cancelled by the customer, who will receive a refund for the order, provided that the order is returned to us. Return shipping costs are the responsibility of the customer.
Blu Kirié is in no way responsible for any problems that may occur during delivery. All our products leave our premises in perfect condition. The customer must check the package upon arrival and report any reservations or claims that appear justified to the carrier or postal service, and, if necessary, refuse the package in case of damage or if it has been opened. In case of damage during transport, the claim must be sent by registered letter with acknowledgment of receipt to the carrier or postal service within three days of receiving the delivery. In case of an error in the preparation of an item or a missing item, the customer must check the order and report any errors or missing items to the brand within 48 hours of receiving the order; after this period, no claim will be accepted.
Blu Kirié reserves the right to refuse to make a delivery from a customer who has not fully paid for a previous order or with whom there is a dispute.
The following are considered as cases of force majeure which release Blu Kirié from its obligation to deliver: war, riot, fire, flood, particularly bad weather conditions, strikes, accidents, pandemics, impossibility of being supplied.

For any order placed on the Site, the Customer may return item(s) via the Site within 14 days of the order receipt date. Delivery charges will not be refunded. Please note that return shipping costs, both within and outside mainland France, are the responsibility of the customer, including duties , customs formalities, and taxes . The shipping costs for the next order, both within and outside mainland France, are also the responsibility of the customer. You have 14 days from the order receipt date to drop off the return at the Post Office; otherwise, the brand may refuse your return. If the order is returned after this legal deadline, a refund cannot be issued. You may only return one item per order.
The customer must send an email to bonjour@blushaofficial.com indicating their choice of return: an exchange for a different size for the same item, or a... You will receive a credit note or refund for a returned item, along with the order number, tracking number, and carrier name. Any return made without prior email notification to the brand will not be processed or accepted; no exchange for an identical item, credit note, or refund will be issued. The item(s) can be collected at your expense.
The customer is responsible for the risks and risks associated with returns. For returns within mainland France, the customer must use a tracked postal service. For returns outside mainland France, the customer must use their preferred carrier. The customer must return the package using a method that provides proof of shipment and a guaranteed delivery date (Colissimo, tracked letter, registered mail with return receipt, carrier, etc.). Without tracking information, your return cannot be processed, refunded, or exchanged for a different size. Any return sent to an incorrect or incomplete return address will not be processed and will be refused; no exchange for an identical item, credit note, or refund will be issued. No returns will be accepted via the Mondial Relay, Chronopost Shop2Shop, Colis Privé, or Relais Colis network, even for orders initially delivered through these services. No exchange for an identical item, credit note, or refund will be issued.
Items must be tried on with your underwear, with the hygienic protective strips still attached, returned in their original packaging, in new condition, neatly folded, complete, suitable for resale, unworn, unwashed, with the original product tags still attached, and with all accessories (straps, removable cups, fasteners, buttons) intact. The order number and delivery note with the tracking slip must also be included . Each returned item must be new, in its original packaging and in its original condition with all tags still attached and all hygiene seals intact. Any item returned incomplete, damaged, deteriorated, soiled, crumpled, washed, or stained will not be accepted. Therefore, a refund or exchange cannot be issued. The product(s) will be returned to you at your expense.
For any products not meeting these conditions, Blu Kirié will not be able to issue a refund, a credit note, or an exchange for a different size. Returned products cannot be returned; the customer will retain ownership of the products, which they may have reshipped to their address at their own expense within fifteen days of Blu Kirié's receipt of the returned item. After this period, unclaimed and unsaleable products will be destroyed. No recourse will then be possible, and Blu Kirié will be considered exempt from any potential commercial action.
In case of a refund request:
The returned item will be refunded to the Customer within 14 days of receipt, inspection, and acceptance by Blu Kirié . You will receive an email informing you of the refund for the item(s).
Once the Products have been received, inspected, and accepted by our services, the refund for the returned Products at the invoiced price will be issued by crediting the amount to be refunded to the Customer's bank account debited during the transaction. This refund may be issued via the same payment method used by the Customer.
In the event of a request for a credit note:
It will be carried out within 14 days of receipt, inspection and acceptance by Blu Kirié of the returned products.
The credit will be issued by means of a credit note equal to the sum of the amount of the returned Products and valid for 6 months.
This credit will be available on the website in the "My discount vouchers" section, under the "My account" category.
This credit can only be used once. Any remaining balance will be lost.
The customer is responsible for the delivery costs of the next order.
When an order is placed with a credit note, in the event that the products are returned, they will not be eligible for a refund or a new credit note; only an exchange for a different size for an identical product will be permitted, and the return and delivery costs will be borne by the customer.
In the event of a request for a size exchange for an identical item:
You will receive an email confirming the new shipment. The brand will cover the shipping costs for the new shipment. Exchanges are limited to one exchange for the same item per order. The exchanged item will not be accepted for return or refund. If the exchange is not collected from the pickup point within the carrier's holding period and is returned to the brand, the customer will be responsible for the cost of reshipping.
The order was shipped and then returned to the sender, Blu Kirié, due to an incorrect address or name (NPAI - Not Living at the Address Provided). The customer must provide a valid and complete address. All costs related to reshipping products due to an incorrect address provided by the customer will be borne by the customer. In the event of a package If the item is not claimed, the order will be cancelled and refunded. Delivery charges will not be refunded.
Article 10 – Right of withdrawal
In accordance with the law, individual customers (non-professionals) have a 14-day withdrawal period from the date of receipt of their order to return the product to Blu Kirié for a full refund without penalty , excluding delivery charges (please note that return shipping costs are the responsibility of the customer). If the customer exercises their right of withdrawal within this period, Blu Kirié will refund the amount paid.

The E-gift card is an anonymous card available for purchase online and valid only on the website, issued to the holder, which can be used for purchases or to give to loved ones.
The amount of the E-gift card available for purchase is from €30 to €300.
SHIPPING - The e-gift card is sent by email to the recipient indicated by the buyer at the time of purchase; the customer will receive an email confirming the payment, indicating the amount and characteristics of the e-gift card, which can be used immediately for the purchase of products online.

Any item ordered via a gift card offered by the brand as part of a competition organized by the brand will not be returned, exchanged, or refunded.
As with all purchases made on the site, you have 14 days to return the item and be refunded or credited with the amount of the returned item or exchanged for a different size for an identical product.

The E-Gift Card can be used during its one-year validity period from its activation date, in one or more installments, up to the amount of the E-Gift Card.

Multiple e-gift cards can be used to pay for the same product. It is possible to supplement the value of the e-gift card with other accepted payment methods; the payment is final and irrevocable. Transactions are deducted immediately from the e-gift card balance.

The E-Gift Card cannot be exchanged, transferred, resold, credited to a card or bank account, discounted, or subject to a request for objection, nor can it give rise to any monetary compensation in any form whatsoever, in whole or in part.
The e-gift card is activated on the day of purchase by the customer who buys the e-gift card. The e-gift card is loaded in a single transaction, in euros, up to the amount determined by the customer who buys the card (i.e., the minimum amount is €30, the maximum amount is €300).
The balance of the e-gift card and the latest transactions made with it can be viewed online.
The E-Gift Card cannot be replaced or refunded in case of loss or theft.
The purchase of an e-gift card cannot be paid for with another e-gift card.
Article 12 Promo Code
If the customer has a promo code, they must enter the code in the field provided for this purpose before validating and paying for the order.
The promo code may or may not apply to delivery charges, as specified before order confirmation.
The promo code cannot be combined with other promo codes.
The promo code has an expiry date.
Article 13 – Intellectual Property
All products and designs, as well as texts, comments, photos, videos, visual identity, trademarks, logos, graphics, concepts, illustrations and animated or still images, databases, site structure, and all other components of the Site are and remain the exclusive intellectual property of Blu Kirié and are protected by French and international intellectual property laws. No one is authorized to reproduce, exploit, redistribute, publish, or use in any way whatsoever, even partially, any components of the site, whether software, visual, or audio.
Any simple or hypertext link is strictly prohibited without the express written consent of Blu Kirié.
ARTICLE 14 – Liability and Guarantee
Responsibility
Blu Kirié, in the online sales process on its website www.blushaofficial.com, is only bound by an obligation of means; its liability cannot be engaged if the site is inaccessible (maintenance, updates, technical improvements, evolution of content) or any damage resulting from the use of the Internet network such as data loss, intrusion, virus, interruption of service, other unintentional problems or any event qualified as force majeure, in accordance with the law and jurisprudence.
Blu Kirié reserves the right to feature a third party on the Site in any way whatsoever, and is not responsible for third-party sites to which visitors are directed from the Site.
Guarantee
The product is covered by the guarantees of conformity and against hidden defects. In the event of a non-conforming product, it may be returned to Blu Kirié, who will accept the return, issue a refund, or provide a credit note.

In the absence of the aforementioned conditions, Blu Kirié will not be able to issue a credit note or refund the returned product. Return shipping costs will be reimbursed to the customer after receipt, inspection, and acceptance, by crediting the refund amount to the customer's bank account debited during the original transaction.
Once the Product has been received, checked, and accepted by our services, Blu Kirié will proceed to send a new product corresponding to the Customer's order.
If the product is no longer available, Blu Kirié will inform the Customer by email and offer them in exchange a credit note or a refund of the amount of the returned Product.
The credit would then be available in the "My discount vouchers" section of the Customer's "My account" category. The refund for the returned Product at the invoiced price will be made by crediting the amount to be refunded to the Customer's bank account debited during the transaction.
The withdrawal period does not restart after receipt of the new Product.
Blu Kirié cannot be held liable for any use of the Site and its services by Clients in violation of these Terms and Conditions, nor for any direct or indirect damages that such use may cause to a Client or a third party. In particular, Blu Kirié cannot be held liable for any false statements made by a Client or for their conduct towards third parties. Should Blu Kirié be held liable due to such conduct by a Client/user, the Client/user agrees to indemnify Blu Kirié against any judgment rendered against it and to reimburse Blu Kirié for all costs incurred in its defense, including legal fees.
Article 15 – Personal Data
The personal information collected is processed electronically for the proper handling of the order. Blu Kirié reserves the right to collect customer information, including through the use of cookies, and, if it so chooses, to share this information with its business partners. Customers can disable the use of these cookies at any time by selecting the appropriate settings in their browser. Customers have the right to access and rectify their personal data, in accordance with the French Data Protection Act of January 6, 1978.
